The following is a legal agreement between you ("the Licensee") and D.G.Farquhar Landscape Photography ("the Licensor"). Read this agreement carefully before purchasing, downloading and using any of the purchased images. By purchasing and downloading any image from D.G.Farquhar Landscape Photography website, you are asserting your declaration that you have read, understood, and agreed to all terms and conditions listed in this Agreement, and otherwise identified on D.G.Farquhar Landscape Photographywebsite. If you are entering into this agreement on behalf of your employer, the license granted and restrictions and limitations recited herein apply to your employer as well as to you as a representative of your employer. Should you cease working for your employer, your employer may continue to operate under this agreement.

All Royalty Free (RF) photographic images available from D.G.Farquhar Landscape Photography website are proprietary, copyrighted by D.G.Farquhar Landscape Photography and protected by British Law, international treaty provisions and other applicable laws. All rights not expressly granted are reserved. Your right to use any of these images is conditioned upon your payment of any applicable fee prior to use and your compliance with the terms of this Agreement.

When you purchase any of D.G.Farquhar Landscape Photography Royalty Free (RF) photographic images, D.G.Farquhar Landscape Photography grants you a non-exclusive (unless other provisions are made), non-transferable limited license to download, use, modify, publish and display image(s) in your personal and/or professional creative work which may include production of:

 A. "Printed Materials," where licensed images are used as illustrations accompanied by the copyright notice. Printed materials include brochures, reports, newsletters, newspapers, magazines, books and any other printed publications where images may be used in editorial and/or advertising context and must contain the copyright notice reading: "©" D.G.Farquhar" or "D.G.Farquhar [Landscape Photography]" or "dfphoto.co.uk "

B."Online and Broadcast Media," where licensed images are used in editorial and/or advertising (commercial) context for World Wide Web site display, online display and broadcast video; provided however that only low-resolution versions of images may be displayed on any World Wide Web site or online and that they shall be accompanied by the copyright notice reading: "© "© D.G.Farquhar" or "D.G.Farquhar [Landscape Photography]" or "dfphoto.co.uk " or

C. "Offline Digital Media" in or as part of computer, audiovisual and multimedia use, software, multimedia programs, interactive presentations and CD ROM products, provided however that only low and medium-resolution versions of images may be displayed in Offline Digital Media, that they shall be accompanied by the copyright notice reading:" © D.G.Farquhar" or "D.G.Farquhar [Landscape Photography]" or "dfphoto.co.uk "

All images licensed hereunder are licensed upon the express understanding, to which you agree by purchasing and downloading the aforementioned images, that although each Royalty Free (RF) image is licensed for multiple use, it may not be distributed to more than 10 (ten) computers (users) within the same company or similar legal entity over computer network or by any other means. Furthermore, you may not make more than one copy of each RF D.G.Farquhar Landscape Photography} image for archival or backup purposes. It is understood that this License does not include any underlying rights nor the privacy or publicity rights of any individuals, trademark, logo or property appearing in the image. Any release for any individuals, trademark, logo or property appearing in the image or permission from their respective unions, guilds, or authorized representatives, if required, must be obtained by the Licensee.

The following uses of the images are expressly not permitted:

1. You may not loan, rent, transfer or grant any rights to D.G.Farquhar Landscape Photographyimages, or any compilation, derivative or collective work containing D.G.Farquhar Landscape Photography  images to any other person or organization without the prior written consent of D.G.Farquhar Landscape Photography.

2. You may not use any of D.G.Farquhar Landscape Photography  images downloaded or obtained from our site in a Website template or any template or design sold individually or as part of an archive or catalog collection, or an automated shopping system, under any circumstances. You MAY however use our photos in client websites that are NOT distributed through an archive or automatic system.

5. You may not use, or allow anyone else to use any of these images in connection with any illegal, obscene, immoral, pornographic, libelous or defamatory material.

You understand and agree that D.G.Farquhar Landscape Photography may, in its sole discretion:

1.       Monitor your download activity from D.G.Farquhar Landscape Photography as often as D.G.Farquhar Landscape Photography  determines under its sole discretion for any reason and for any violation of this Agreement.

2.       Investigate any abuse of your username and password in connection with the D.G.Farquhar Landscape Photography  website or in connection with this Agreement.

3.       Take the appropriate action to investigate all potential abuse, which can lead to contacting the individual involved with the violations or other actions deemed necessary depending on the nature and severity of the violations, if we are unable to confirm the validity of the activity.

You understand that D.G.Farquhar Landscape Photography  images are copyrighted and owned and/or represented by D.G.Farquhar Landscape Photography  and any unauthorized use of any of these images by you may be an infringement upon said copyright.

Limitation of Damages

All D.G.Farquhar Landscape Photography images are made available to you "AS IS," "AS AVAILABLE," and "WITH ALL FAULTS". NeitherD.G.Farquhar Landscape Photography  nor any of its officers, agents, employees, representatives, associates or its licensors shall be liable for any damages, whether direct, indirect, consequential, or incidental, including but not limited to loss of revenue or profits, arising out of the use of, or inability to use of any image or images on this website. Furthermore, D.G.Farquhar Landscape Photographyits employees, directors, and officers and anyone else associated with D.G.Farquhar Landscape Photography make no representation or warranty, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, or non-infringement.

Age of Majority. 

You warrant and attest that you are of the age of majority. You further agree that you fully understand the contents, meaning and impact of this agreement.  You will not use theseD.G.Farquhar Landscape Photography images in any way that is not permitted in this Agreement or in violation of this Agreement.  Your use of these D.G.Farquhar Landscape Photography will not violate any applicable law or regulation of any country, state, or other governmental entity.  You further attest that the information you provide to D.G.Farquhar Landscape Photography is accurate and true, including without limitation all credit card information.

You agree to fully indemnify and hold harmless D.G.Farquhar Landscape Photography , its employees, directors, officers, and any other entity associated with D.G.Farquhar Landscape Photography , and each  of its successors, licensees and assigns free and harmless from any and all claims, liabilities, costs, losses, damages, expenses, including attorneys's fees and expenses, arising in connection with your use of the D.G.Farquhar Landscape Photography  images and this website or of any breach or alleged breach of any representation, warranty, or other promise made by you in this Agreement.

Governing Law and General Provisions

This License is the entire agreement between the parties and supersedes any other agreement or discussions, oral or written and may not be changed except by a written signed agreement. This License shall be governed and construed in accordance with the British Law. If any provision of this License is declared by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provisions shall be severed from the License to the minimal degree necessary and the other provisions shall remain in full force and effect. The prevailing party in any enforcement action shall be entitled to an award of its reasonable attorneys' fees.

You agree, attest, and reaffirm your agreement to the terms listed herein and to conduct your transaction electronically.
